Sarcio Solutions Inc. (Owner of LovethatDeal.ca) also referred to hereinafter as (“lovethatdeal.ca” and/or “Love that Deal”) and also referred to as “we”, “us” and “our”, provides this website (the “Site”) to you, subject to these terms and conditions. The services and Site are collectively referred to here as “Love That Deal”.  The term “you” or “User” refers to the person using or accessing the Site or our services or the organization or company on whose behalf that person accesses the services or the Site. By accessing or using the Site or any Love That Deal service, you are explicitly agreeing to be bound by these terms, as well as our Privacy Policy. (Click here to view Privacy Policy). Please review the following terms carefully before using this Site. IF YOU DO NOT AGREE TO ALL TERMS AND PROVISIONS WITHIN THE SITE TERMS, CONDITIONS AND PRIVACY POLICY PLEASE DO NOT USE THIS WEBSITE OR ANY SERVICES PROVIDED THEREIN.  By accessing this Site, you agree that you have read, understood, and agreed to all of the following Terms and Conditions and consent to be bound thereby, including any future amendments or updates.

The use of this Site (which may or may not include participating in a commercial transaction), and/or by purchasing any Voucher or Coupon from this Site is conditional upon your acceptance of these Terms and Conditions. Love That Deal reserves the right to revise the Terms and Conditions and our Privacy Policy as we consider necessary or desirable without prior notification to Users, including the implementation of new fees or charges.  It is your responsibility to check the Site regularly to review the current legal notice as it is binding on you.  By using the Site after any such changes have been made to the Terms of Use and Conditions and/or the Privacy Policy, you are implicitly accepting and agreeing to such changes. Changes are effective immediately upon posting to this site. If you do not agree to any of the Terms and Conditions, you must stop using the site.

Our Services

Love That Deal is an online website which provides the opportunity to purchase (in Canadian Dollars ONLY via Mastercard or Visa) special time limited deals for products and services hereafter referred to as the deal ("Deal"), by the electronic issuance of a Coupon/Voucher hereafter referred to as ("Coupon/Voucher") of third party merchants, hereafter referred to as the (“Merchant”). We negotiate offers which are referred to in these Terms and Conditions. We are not the supplier of the goods and/or services.  The Merchant has agreed to redeem the Coupons/Vouchers purchased through this site. 

Your Status and Responsibility

Your permission to use the Site and/or purchase a coupon/voucher is based upon your agreement that you:

• are 18 years of age or older
• are human. You may maintain only one account.  Any duplicate accounts will be subject to cancellation
• are legally capable of entering into binding contracts
• are a resident of Canada
• will comply with the terms of service
• will not copy or distribute any part of Love That Deal without prior written authorization
• will provide accurate information when creating an account or using our services
• are solely responsible for your User ID and password and the activity that transpires while signed into or using Love That Deal under that ID
• are solely responsible for your content and submissions, including posts, profiles, information, and links and other such content
• will not share your User ID and/or password with anyone.  The security of this information is solely your responsibility
• will not submit content that is copyrighted or subject to third party proprietary rights unless you are the owner of the rights, or have express written permission to specifically submit them to Love That Deal
• grant us an irrevocable non-exclusive license to use any content you post on our Site or otherwise communicated to us via any type of media
• agree that we have the right to remove any and/or all of your submissions and terminate your account with or without prior notice

Our Status

• https://lovethatdeal.ca/ and related microsites which compose our Site is operated by Sarcio Solutions Inc. We are registered and incorporated in Canada.
• When you complete the online purchase, we will send the coupon/voucher to you as soon as reasonably practical, after receiving payment from you with respect to the coupon/voucher.
• The Merchant is the seller of the goods and or services under the Deal and is responsible for ensuring the Deal and the goods and/or services provided comply with all applicable laws.
• Love That Deal’s obligations under this agreement are solely to issue the Love That Deal Coupon/Voucher to you, under the Deal. The Merchant is solely responsible for supplying goods and/or services and redeeming any such Love That Deal voucher, pursuant to their Terms and Conditions of sale.
• Love That Deal reserves the right to modify or terminate the Love That Deal Site and/or service for any reason, at our discretion, without notice at any time and from time to time.
• Except as otherwise expressly prohibited by law, we reserve the right to refuse service to anyone for any reason at any time.
• We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable or violate (or may violate) any party’s intellectual property rights.
• Should the Merchant be unable to provide the services or goods purchased within the Deal, because of business failure, Love That Deal will attempt to, but is not obligated to, provide a credit for the purchase price paid for any unredeemed Voucher/Coupon, except as dictated by applicable law.

Limitations regarding Liability

Love That Deal disclaims any and all responsibility or liability in relation to the Deal made available on the Site and any goods or services supplied in relation to it to the maximum extent permissible by law. Neither Love That Deal nor its directors, agents, employees, officers or Affiliates may be held liable whether in relation to contract, warranty, tort (including negligence), product liability, tax matters or any other form of liability for any claim, damage or loss, arising from or relating to the provision of all or any goods or services sold or agreed to be supplied pursuant to the Deal. Love That Deal does not make any representations or guarantees regarding any goods or services offered or provided by sponsors, suppliers or the Merchant. We do not guarantee that Love That Deal will meet your requirements, is error-free, reliable, without interruption or available at all times. We do not guarantee that the results that may be obtained from the use of Love That Deal, including any services or Deals, will be effective, accurate, reliable or meet your requirements. We make no warranties regarding privacy, other than those stated in the privacy policy. We do not guarantee that you will be able to access or use the site or services at times or locations of your choosing. No oral representative shall create a warranty.

We may provide links on our site to the websites of other companies, whether affiliated to us or not. We cannot provide any guarantee that products you purchase from third party sellers, or from companies to whose website we have provided a link on our site, will be of satisfactory quality. Any such warranty is disclaimed by us absolutely. To the maximum extent permitted by law, we and our director's agents and vendors disclaim implied warranties. This disclaimer does not affect your rights against the third party seller or the Merchant. We may disclose your customer information related to the Deal that you have purchased to the Merchant. Love That Deal reserves the right, but has no obligation to, review or take any action Love That Deal deems appropriate regarding disputes you may have with other customers of ours or any Merchants.

The communication between the User and Love That Deal is done via electronic means and therefore, for contractual purposes, you consent to receiving communications from Love That Deal in an electronic form and that all Terms and Conditions, Agreements, notices, disclosures and any other electronic communication Love That Deal makes with you electronically, satisfy any legal requirement that such communications would satisfy if it were in writing. Should any part of this Agreement be held unenforceable or invalid, that portion will be construed consistent with applicable law and the remaining portions will remain in full effect. Our failure to enforce any provision of this Agreement will not be considered a waiver of the right to enforce such provision. Our rights under this Agreement will survive any termination of this Agreement.

You and Love That Deal agree that any cause of action arising out of or related to Love That Deal must commence within one (1) year after the cause of action accrues, otherwise such cause of action is permanently barred.

Refunds

As a consumer, you may cancel a Contract (purchase of a Voucher/Coupon) at any time within 72 hours commencing after the close of the respective Deal, provided that you have not exchanged the Love That Deal Voucher/Coupon for the goods and/or services under the Deal in that time. In this case, you will receive a full refund of the price paid for the Love That Deal Voucher/Coupon in accordance with our refund policy. After 72 hours no refunds will be permitted. If there is an obvious pricing error in relation to the Deal which could have reasonably been recognized by you as a mis-pricing then we have the right to cancel any Love That Deal Voucher/Coupon issued in respect of the Deal and issue you a refund in respect of the same. Should the merchant be unable to provide the services or goods purchased on this Deal because of business failure, within (30) thirty days of the issuance of the Voucher/Coupon, or is unwilling to redeem the voucher according to the conditions and limitations printed on the Voucher/Coupon, please contact support@lovethatdeal.ca and we will credit in full the purchase price paid for any unredeemed Voucher(s)/Coupon(s) to your Love That Deal account.

Payment for all products and services must be made by credit card. We will charge your credit card when you offer to buy a Love That Deal Voucher/Coupon.

Website Access

While we will endeavour to ensure that the website is available 24 hours a day, we shall not be liable if for any reason the Site is not available at any time for any period of time. Access to the Site may be suspended temporarily and without notice due to repair, maintenance, system failure or for reasons beyond our control. Love That Deal assumes no liability with regards to viruses, corrupted data, or other harmful, destructive or disruptive files. While Love That Deal attempts to ensure that the Site and servers are safe and free from harmful components, Love That Deal disclaims all liability without limitation to the full extent the law provides.

The Site may contain links to third party websites, as a convenience to Users who may be interested in the information. Love That Deal does not monitor, endorse, sponsor, or have any control over the quality, content, policies or reliability of the third party sites. When you leave the Site, our terms and policies no longer govern. It is your responsibility to endeavour to investigate the third party sites terms and conditions before proceeding.

Under no circumstances will Love That Deal be liable for any loss or damage caused by the User’s reliance on information obtained through Love That Deal.

Ownership and Copyright

The Site and all content contained herein are the proprietary property of Sarcio Solutons Inc., and are protected by Canadian and international copyright laws. All rights to the site are expressly reserved.

Deals

Love That Deal offers consumers the opportunity to purchase products and services from third party Merchants, a time limited promotional, value added deal discounted from the typical cost, by the electronic issuance and delivery of a Voucher/Coupon.

How It Works

In order to use our Site to place an order, to select your Deals, pay for your Deals, and print the applicable Voucher/Coupon for the applicable Merchant, you must have a valid email address and create an account with Love That Deal. By placing an order for a specific Deal, you are agreeing to the terms, restrictions, and conditions associated with the specific Deal, as well as those stated on our Site within these Terms and Conditions. The Deal’s specific terms expressly supersede any inconsistent terms in this Agreement except to the extent otherwise prohibited by applicable law. Once you have placed your order, you will receive a confirmation email regarding the Deal, and your credit card will be charged for the amount of the Deal. An email will be sent to you with the Voucher/Coupon, and/or reference code.

The Voucher/Coupon

The Voucher/Coupon is comprised of two separate portions that make up the Deal:

1. the paid portion equal to the amount your credit card is charged, (the “Paid Portion”);
2. at no additional charge to you, a promotional portion, (the “Promotional Portion”) for the balance of the value of the Deal, if redeemed by the promotional expiration date on the Voucher/Coupon, (which are the two portions together).

If you redeem your Voucher/Coupon for less than the full amount stated on the Voucher/Coupon, your purchase will be allocated first against the Paid Portion until it has a balance of zero dollars ($0.00) and then against the Promotional Portion that remains.

Expiration Date

The expiration date for a Voucher/Coupon is as printed on the Voucher/Coupon, except to the extent otherwise required by applicable law. While the expiration date on the Voucher/Coupon dictates the last date on which you can use your Voucher/Coupon to redeem from the Merchant any unredeemed Promotional Portion, applicable law may require that the Merchant is responsible for the unredeemed Paid Portion. Any and all redemptions must be made by the Merchant, who is obligated to honour the Voucher/Coupon in compliance with the law.

Merchant Status

Love That Deal is not a “traditional” retailer. Rather, Love That Deal is a venue which gives the opportunity for a User who complies with the User Agreement to purchase a Voucher/Coupon for a Deal from a Merchant. We are not involved in the actual transaction between buyers and sellers, and as a result have no control over (or liability for) the safety, legality, sufficiency, or quality of the items advertised, the truth or accuracy of the listings, or the ability of Merchants to sell goods and services. We cannot ensure that a Merchant will actually complete a transaction. Therefore, Love That Deal does not transfer legal ownership of items from the Merchant to you. As the issuer of a Voucher/Coupon, the Merchant, (not Love That Deal) is fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect to a customer caused in whole or in part by the Merchant or its products and/or services, as well as for any unclaimed property liability arising from unredeemed or partially unredeemed Vouchers/Coupons. The purchase of a Deal simply allows you the right to print the Voucher/Coupon being offered by the participating Merchant in connection to that Deal and to use the Voucher/Coupon according to its terms and the terms of this User Agreement. It is the Users sole discretion as to whether the Voucher/Coupon is printed and/or redeemed, and therefore Love That Deal has no responsibility or liability in that regard.

General Terms

Unless otherwise state in the Voucher/Coupon, or required by law, the following additional terms apply to all Vouchers/Coupons:

• there is no cash value for any Voucher/Coupon
• duplicate use, reproduction, sale or trade of a Voucher/Coupon is prohibited
• only one (1) Voucher/Coupon can be used for each respective deal unless otherwise specified by the Merchant
• restaurants generally accept one voucher for 2-3 people; two vouchers for 4-5 people; and three vouchers for 6 or more people
• no cash back or credit will be issued for partial redemption of the promotional portion of a Voucher/Coupon
• no cash back or credit will be issued for partial redemption of the paid portion of a Voucher/Coupon, except as required by law
• any attempted redemption which is not consistent with the terms and conditions of this user Agreement will render the Voucher/Coupon null and void
• Vouchers/Coupons are redeemable in their entirety on a one time basis only and may not be redeemed incrementally
• use of a Voucher/Coupon for alcoholic beverages is at the sole discretion of the Merchant (and may be limited by law)
• Vouchers/Coupons may not be combined with any other coupons, promotions, discounts, or gift cards unless specifically stated
• Vouchers/Coupons cannot be used for tips, taxes, prior balances, previous purchases, shipping or handling unless specified by the Merchant
• Vouchers/Coupons that are pertaining to restaurants are valid only for in restaurant dining, unless otherwise agreed upon by the Merchant
• Vouchers/Coupons where the Merchants are restaurants may also have statutory limitations on the amount of the Voucher/Coupon value that can be redeemed for alcoholic beverages. Compliance with statutes or codes is the sole responsibility of the Merchant, as Love That Deal has no role in such determination
• neither Love That Deal nor the Merchant is responsible for lost or stolen Vouchers/Coupons, or lost or stolen reference numbers
• unless specifically stated on the Voucher/Coupon the amount paid by the Voucher/Coupon does not include sales tax, which may be additionally and separately charged to you by the Merchant at the time you redeem your Voucher/Coupon

Additionally, each Deal has specific terms associated with the Deal, which will be shown to you at the time you commit to purchase the specific Deal. The specific terms of the Deal supersede any inconsistent terms in the Agreement, except to the extent such terms are prohibited by applicable law.

User Material and Conduct

The User is prohibited from posting or transmitting to or from the Site any material:

• that is obscene, indecent, defamatory, threatening, seditious, pornographic, offensive, abusive, liable to incite racial hatred, menacing, scandalous, discriminatory, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience
• which constitutes or encourages conduct that would be considered a criminal offence, gives rise to any type of liability, or otherwise be contrary to the law or infringe the rights of any third party, in any country in the world
• that could be harmful to minors
• that infringes the copyright, trademark, trade secret or other intellectual property or proprietary rights of others
• that is false or misleading
• that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity
• that is an unsolicited promotion, political campaigning, advertising, or solicitations; or which is technically harmful or could damage, overburden, disable or impair the the Site, including but not limited to, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or any other harmful data, or malicious software; or misuse the Site in any way, including but not limited to hacking and/or the use of robots, spiders, scrapers or any other automated means to access the site
• which in the sole judgement of Love That Deal is objectionable, or which restricts or inhibits any other person from using or enjoying the Site

By posting or distributing Content to or through our Site, you grant Love That Deal a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, distribute, publish, create derivative works from and publicly display such Content throughout the world in any media. The information you submit is not subject to any confidentiality obligation. Information such as credit card information provided in connection with the purchase of a Deal is maintained with appropriate privacy and security protections.

If you believe any content posted on the Site is in breach of these terms, or in any other way infringes your rights, you can contact us at support@lovethatdeal.ca . Please include the listing, date and time of the content/comments concerned as well as the basis of your concern and the action you deem required.

If the User violates these Terms and Conditions, whether the User is a registered Love That Deal User or not, Love That Deal reserves the right to terminate the User access to any or all of the services at any time with or without notice.

Indemnity

The User agrees to defend and indemnify and hold harmless Love That Deal and all of its agents, directors, employees, providers, licensors, and licensees, from and against any and all liability and costs, including, without limitation to, attorney fees, arising out of or related to our Site, our services, and Merchants, Deals and/or this User Agreement, including but not limited to, your breach of this User Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party. This defence and indemnification will survive these Terms and Conditions and your use of Love That Deal.
